This Agreement is an official public offer by Sole Proprietor Mykola Chernyshuk (hereinafter referred to as the “Contractor”) to conclude a contract on the terms set forth below.
Each person who accepts this offer confirms their agreement to all terms of this Agreement and becomes the Customer.
1.1. The Contractor undertakes to provide the Customer with services related to development, configuration, design, maintenance, and other related works connected with website creation, and the Customer undertakes to accept and pay for these services.
2.1. The Agreement is concluded by acceptance (acceptance) of this offer, which is equivalent to concluding a written contract in accordance with Article 642 of the Civil Code of Ukraine.
2.2. Acceptance of the offer means placing an order via the website https://nweb.website, by email, or by any other means of communication with the Contractor.
2.3. The fact of making a prepayment or full payment for services is also considered acceptance of the offer.
3.1. The Contractor undertakes to:
provide services of proper quality and within agreed deadlines;
coordinate key development stages with the Customer;
ensure confidentiality of the provided data.
3.2. The Customer undertakes to:
provide accurate and complete information necessary for the provision of services;
make payments timely;
accept the provided services or express justified comments within the established term.
4.1. The cost of services is determined individually, according to the rates published on the website or agreed upon in correspondence.
4.2. Payment is made either in full (100% prepayment) or in stages — by agreement of the parties.
4.3. Payment can be made to the Sole Proprietor’s account or other details specified on the website or in the issued invoice.
5.1. Service delivery deadlines are discussed individually and depend on the project complexity.
5.2. Changes to deadlines are possible by agreement of the parties or due to force majeure circumstances.
6.1. Upon completion of the work, the Contractor notifies the Customer and delivers the result.
6.2. In the absence of written comments within 5 (five) calendar days, the service is considered duly rendered.
7.1. The Contractor guarantees that the services comply with the agreed technical requirements.
7.2. The Contractor is not responsible for:
functioning of third-party websites;
lack of access to the website due to hosting provider faults;
actions of third parties.
7.3. All disputes shall be resolved by negotiation or in accordance with the legislation of Ukraine.
8.1. The parties are released from liability for failure to perform obligations due to force majeure circumstances (war, natural disasters, power outages, etc.).
9.1. The Contractor has the right to change the terms of this offer without prior consent of the Customer by publishing a new version on the website.
9.2. All materials created by the Contractor may be used in the portfolio unless otherwise agreed by the parties.
9.3. This Agreement is effective from the moment of acceptance and until full performance of obligations by the parties.
